Howard Stern Sues Google, Baba Booey Unavailable for Comment

Google’s getting sued by Howard Stern over what he and co-plaintiff CLRB Hanson Industries are calling “misrepresentation” on the Google AdWords system.

The dispute centers around daily budgets, the pre-set spending limit which the AdWords system sets for each campaign. While Google regularly refunds customers charged more than 120% of a daily budget, the lawsuit contends that Google has broken this promise on more than one occasion. The suit further asks that all charges in excess of the daily budget be dropped.

Like Mike on Techdirt says, this shouldn’t be thought of as a big deal. Unless of course, you make the case that Google’s use of the term “daily budget” isn’t clear in terms of its wording. Should a $500 hundred dollar daily budget literally mean $500 dollars? It’s up to the lawyers to decide. Until then, Howard Stern is sure to give us an earful.
