Farmdate ‘Courts’ Google, Loses

Google’s big enough now that we’re no longer surprised by the kind of lawsuits that get sucked into its gravity. The latest: it’s now the opinion of a Dutch court that Google’s paid search listings aren’t too sexy for a dating site focused on farmers.
Last week, we told you that Farmdate.nl raised a legal objection to the kinds of AdWords ads often associated with its organic search listing. Specifically, they objected to ads for “sex” sites, because in their opinion the juxtaposition of ’sex’ and ‘dating’ was bad for its reputation.
The judge did not agree, and he told them so-oh-oh-oh, says Reuters. The legal opinion wasn’t quite the same as our opinion, though (our opinion, for the record: “that’s ridiculous.”) Farmdate wanted Google to install a filter just for them that would block out the ads it objected to. According to the story, though, the judge said that the terms “farm” and “date” were far too generic to be “granted exclusivity” by Farmdate.
But say you had a site associated with “exclusive” terms on which you owned a trademark or a copyright. This ruling would seem to leave the door open (at least in the Netherlands) to complain to Google about the types of ads served on those keywords, whether they were for competitors or not. Not that we see a whole lot of special filters in Google’s immediate future; just more lawsuits.
